§1. General provisions
The Drink Radar application (hereinafter the "App") is a social platform enabling adult users to make social contacts in real time. These Terms cover the mobile app (iOS, Android) and the browser version available at drinkradar.net.
The operator of the App is Kamila Franz, contact: drinkradar@drinkradar.net (hereinafter the "Operator").
Using the App constitutes acceptance of these Terms and of the Privacy Policy.
The Terms are available at any time within the App and at a public web address, free of charge, in a form that allows them to be downloaded and stored.
§2. Conditions of use
The App is intended exclusively for persons who are at least 18 years old. Use of the App by minors is prohibited.
Before starting to use the App, the user makes an explicit declaration of being at least 18 years old and confirms having read and accepted these Terms and the Privacy Policy. Refusing to make this declaration prevents further use of the App.
Registration in the App requires providing an e-mail address (confirmed via an activation link) and a phone number, verified by a one-time SMS code (OTP).
The user is obliged to provide true data during registration and profile creation, including their real age.
Each user may hold only one account. The Operator reserves the right to remove duplicate accounts.
The Operator reserves the right to request additional age or identity verification in the case of justified doubts about the truthfulness of the data provided by the user.
§3. Community rules and prohibited content
Users undertake to:
behave politely and respectfully towards other participants,
not share offensive, vulgar content, content inciting hatred, discriminatory content or content otherwise violating the law,
not share content of an explicitly sexual or pornographic nature, or content depicting violence,
not use the App for commercial, advertising or solicitation purposes without the Operator's consent,
not interfere with the functioning of the App or IT systems, including not attempting to bypass security measures,
not send spam or unsolicited messages,
not use the App to harass, intimidate, stalk or otherwise harm other users.
The Operator applies a zero tolerance policy towards content and behaviour violating the above rules, in particular towards content threatening the safety of other users, hate speech and attempts to contact minors.
Photos and text content submitted by users are subject to automated moderation before publication or sending. Content flagged as violating the rules will not be published or sent, and the user will receive an appropriate message.
Automated moderation decisions can be appealed — each such decision will be reviewed by a human on the Operator's side at the user's request (appeals: drinkradar@drinkradar.net).
§4. Reports, blocking and moderation
Every user may block another user, report them to the Operator and report an individual chat message — directly from within the App.
Violation reports are reviewed by the Operator without delay, where possible no later than within 72 hours of receiving the report.
In the case of a justified report, the Operator may take action, including: removing the violating content, temporarily suspending the account, or permanently deleting the account of a user violating the Terms.
The Operator reserves the right to remove content (including photos, bios) violating the Terms without prior notice, where required to protect community safety.
A user whose account has been suspended or deleted as a result of violating the Terms may appeal the decision by contacting the Operator at drinkradar@drinkradar.net.
§5. Location and privacy
Sharing location is entirely voluntary and requires the user's explicit, separate consent, independent of the acceptance of these Terms.
By consenting to location sharing, the user accepts that their approximate position will be visible to other logged-in users on the map.
Consent to location sharing can be withdrawn at any time in the App or device settings, without affecting the ability to use the App's other features.
The user may individually share their position with chosen friends (a friendship requires mutual consent) in one of three modes: real position — exact, visible also in ghost and safe modes; safe — with an offset of approx. 1 km; off — under the general rules. The setting can be changed at any time in the Friends tab.
The optional “Background signal” feature (Android and iOS) is off by default — the user enables it manually in the Profile tab and can turn it off at any time. Detailed rules of how it works are set out in the Privacy Policy.
Detailed rules for processing personal data, including location data, are set out in the separate Privacy Policy.
§6. Club accounts
The Operator enables club (venue) accounts in the App, presenting the venue's profile, photos, amenities, events and announcements.
A club account may only be created by a person authorized to represent the given venue; verification of the club's phone number via SMS code is required.
The club account administrator is responsible for the truthfulness of published content (including event dates, prices and descriptions). Impersonating other venues and publishing content misleading to users is prohibited.
Club content is subject to the same moderation rules as user content (§3). The Operator may remove content or suspend a club account violating the Terms.
A club's presence on the map and its content do not constitute a recommendation or guarantee by the Operator as to the quality of the venue's services. Any complaints regarding the venue's services should be directed to the club directly.
Separately from club content, the App may present ticketed events (e.g. concerts, parties) originating from external ticketing operators and event services, based on information they make publicly available.
The Operator is neither the organizer nor the ticket seller for these events — tickets are purchased solely on the external operator's website, under that operator's own terms. The Operator is not responsible for the currency of dates, prices or ticket availability, nor for the cancellation or rescheduling of an event; any complaints should be directed to the organizer or the ticket seller.
The App allows users to submit event declarations ("Interested", "I'm going"). A declaration is purely informational for the community (only aggregate counts are public) — it does not constitute a seat reservation or a ticket purchase.
Some events may be featured (promoted) by venues — in such cases they are clearly marked with a "Featured" badge. Featuring is promotional in nature and does not constitute a recommendation by the Operator.
§7. Radar points system
The App may award users radar points and ranks for activity, in particular for real, confirmed meetups with other users and the first confirmed attendance at an event (one-time). A club check-in itself does not award any points — it is used solely for the venue's attendance stats.
Radar points and ranks are purely symbolic (a gamification element), have no monetary value, cannot be exchanged for money, goods or services, and are not transferable between accounts.
Artificially inflating points is prohibited (in particular faking location, creating multiple accounts, arranging fictitious meetups). In such cases the Operator may revoke points, lower the rank or suspend the account.
The Operator may change the rules for awarding points or end the points program at any time, without any obligation to compensate.
§8. Safety of real-world meetups
Drink Radar is solely a technical tool facilitating contact. The Operator does not organize, does not intermediate in organizing, and is not a party to any meetup arranged by users. The decision about a meetup, its place, time and course rests solely with the users.
The Operator does not verify users' criminal records, legal identity, health condition, sobriety or intentions. Verification is limited to confirming an e-mail address and a phone number, and does not guarantee that profile data is true.
The user uses the App and meets other people solely at their own risk and responsibility.
The Operator recommends: meeting for the first time only in public places, informing a person close to you about the meeting place, arranging your own return transport, not accepting drinks from strangers and never leaving your drink unattended, not sharing financial data, home address or documents, and immediately ending contact if you feel threatened or uncomfortable.
Using the App to arrange a meetup in order to commit a criminal act is prohibited, in particular violence, threats, theft, fraud, trafficking in intoxicating substances, providing sexual services or benefiting from them.
The App is not a rescue, security or alarm service. In a situation of danger to life, health or safety, immediately notify the services by calling 112, then report the incident to the Operator at drinkradar@drinkradar.net.
The Operator cooperates with law enforcement authorities. In the case of suspected commission of a crime, the Operator may block the account and hand over the held user data (including e-mail address, phone number, IP addresses, location data and contact history) to the authorized authorities at their request or in order to report a crime. Using the App does not provide anonymity from state authorities.
Consuming alcohol during meetups takes place solely at the user's responsibility. The App does not encourage alcohol consumption, does not sell it and does not intermediate in its sale. Driving a vehicle after consuming alcohol is prohibited.
§9. Liability
The Operator provides hosting of user content within the meaning of the Polish Act on Providing Services by Electronic Means and Regulation (EU) 2022/2065 (Digital Services Act). The Operator has no general obligation to monitor content transmitted by users and is not liable for such content unless it is aware of its unlawful nature; upon receiving credible information about the unlawful nature of content, the Operator promptly disables access to it.
The Operator is not liable for any damage to person or property — including bodily harm, injury, theft, fraud, insult, harassment, violence, sexual offences, infection with disease or the effects of alcohol consumption — arising in connection with a meetup or contact between users outside the App. Liability for such events rests solely with their perpetrator.
The Operator is not liable for the truthfulness of data provided by users (including age, name, photos and bio), for the content of messages, or for the actions of users impersonating other persons.
The Operator exercises due care to ensure the App functions correctly and securely, but does not guarantee uninterrupted and error-free operation of the App, availability of external services, accuracy of location data or the effectiveness of automated moderation.
The Operator's liability towards users who are not consumers is limited to damage caused by wilful misconduct and is excluded as regards lost profits and indirect damage. Towards consumers, limitations of liability apply only to the extent permitted by mandatory provisions of law — the provisions of these Terms do not exclude or limit consumer rights arising from the law.
The App is free of charge, and using it does not create any obligation on the Operator's part to ensure any result (in particular meeting anyone or holding a meetup).
The Operator (including the App's creator and owner) is not liable for the use of the App by users in a manner contrary to the law, to the Terms or to the App's intended purpose — in particular for criminal acts, violations of personal rights, fraud, harassment or other abuses committed by users using the App. Criminal, civil and administrative liability for such actions rests solely with the persons who committed them. The Operator's role is solely to provide a technical tool and to respond to reported violations in accordance with §4.
A user who has violated the Terms or the law bears full liability towards third parties and undertakes to release the Operator from all claims, costs and expenses (including legal service costs) directed against the Operator in connection with that violation, to the extent permitted by law.
§10. Account deletion
The user may delete their account at any time, directly from within the App (Profile tab) or by sending a request to drinkradar@drinkradar.net.
Account deletion is irreversible and results in the permanent deletion of the user's profile data, photos and messages, in accordance with the rules described in the Privacy Policy.
§11. Changes to the Terms
The Operator reserves the right to change the Terms, in particular in the event of changes to the App's functionality or applicable law. Users will be informed of material changes via the App or by e-mail, with appropriate notice before they enter into force. Continued use of the App after the changes take effect constitutes their acceptance.
§12. Final provisions
In matters not regulated by these Terms, the provisions of Polish law apply, including the Civil Code and the Act on Providing Services by Electronic Means.
Any disputes arising from the use of the App will be resolved by the competent court in accordance with applicable law.
If any provision of these Terms is found to be invalid, the remaining provisions remain in force.
